COMMISSION OPINION of 31 July 1973 to the Government of Ireland concerning a proposed measure implementing Regulation (EEC) No 2829/72 (73/307/EEC)

On 10 April 1973 the Permanent Representation of Ireland wrote to the Commission enclosing the proposed text of a measure designed to implement Council Regulation (EEC) No 2829/72 (1) of 28 December 1972 on the Community quota for the carriage of goods by road between Member States.

This constituted consultation within the meaning of Article 7 of Council Regulation (EEC) No 2829/72, which provides that the Member States shall, after consulting the Commission, adopt the laws, regulations or administrative provisions necessary for the implementation of that Regulation and that such measures shall cover in particular the organization of, procedure for, and means of carrying out inspection, and the penalties for infringements.

The Commission notes that the proposed measure contains the necessary provisions in respect of penalties and that the Irish Government, as stated in the letter dated 20 June 1973 from its Permanent Representation, has by administrative action adopted appropriate measures in respect of inspection.

As regards their intention and general content, the measures proposed or already adopted fulfil the requirements of Council Regulation (EEC) No 2829/72.

The Commission would however suggest that these measures could usefully be supplemented, particularly as regards penalties, by provisions as indicated in the Commission Recommendation of 9 June 1969 (2) to the Member States concerning the implementation of certain provisions relating to the Community quota.
