DECISION OF THE EEA JOINT COMMITTEE

No 89/2016

of 29 April 2016

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2017/2039]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)	Directive 2014/53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC (1) is to be incorporated into the EEA Agreement.

(2)	Directive 2014/53/EU repeals, with effect from 13 June 2016, Directive 1999/5/EC of the European Parliament and of the Council (2), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 13 June 2016.

(3)	Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XVIII of Annex II to the EEA Agreement shall be amended as follows:

The following point is inserted after point 4zzq (Commission Decision 2013/638/EU):

‘4zzr.

32014 L 0053: Directive 2014/53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC (OJ L 153, 22.5.2014, p. 62).’

The text of point 4zg (Directive 1999/5/EC of the European Parliament and of the Council) shall be deleted with effect from 13 June 2016, except for the first indent (Commission Decision 2000/637/EC), which will still be in force after 13 June 2016, and therefore is inserted as a new point after point 4zg (Directive 1999/5/EC of the European Parliament and of the Council):

‘4zga.

32000 D 0637: Commission Decision 2000/637/EC of 22 September 2000 on the application of Article 3(3)(e) of Directive 1999/5/EC to radio equipment covered by the regional arrangement concerning the radiotelephone service on inland waterways (OJ L 269, 21.10.2000, p. 50).’

Article 2

The text of Directive 2014/53/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 30 April 2016, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
