amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 104/2001 of 28 September 2001(1).

(2) Directive 2003/37/EC of the European Parliament and of the Council of 26 May 2003 on type-approval of agricultural or forestry tractors, their trailers and interchangeable towed machinery, together with their systems, components and separate technical units and repealing Directive 74/150/EEC(2) is to be incorporated into the Agreement.

(3) Directive 2003/37/EC repeals, with effect from 1 July 2005, Council Directive 74/150/EEC(3), which is incorporated into the Agreement and which is consequently to be repealed under the Agreement.

(4) Commission Directives 98/38/EC(4), 98/39/EC(5), 2000/2/EC(6) and 2001/3/EC(7), which have been incorporated as acts amending Directive 74/150/EEC, should be moved to separate points under Chapter II of Annex II to the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter II of Annex II to the Agreement shall be amended as follows:

1. The text of point 1 (Directive 74/150/EEC) is deleted with effect from 1 July 2005.

2. The following points are inserted after point 23 (Council Directive 89/173/EEC):

"24. 398 L 0038: Commission Directive 98/38/EC of 3 June 1998 adapting to technical progress Council Directive 74/151/EEC on certain components and characteristics of wheeled agricultural or forestry tractors (OJ L 170, 16.6.1998, p. 13).

25. 398 L 0039: Commission Directive 98/39/EC of 5 June 1998 adapting to technical progress Council Directive 75/321/EEC relating to the steering equipment of wheeled agricultural or forestry tractors (OJ L 170, 16.6.1998, p. 15).

26. 32000 L 0002: Commission Directive 2000/2/EC of 14 January 2000 adapting to technical progress Council Directive 75/322/EEC relating to the suppression of radio interference produced by spark-ignition engines fitted to wheeled agricultural or forestry tractors and Council Directive 74/150/EEC relating to the type-approval of wheeled agricultural or forestry tractors (OJ L 21, 26.1.2000, p. 23).

27. 32001 L 0003: Commission Directive 2001/3/EC of 8 January 2001 adapting to technical progress Council Directive 74/150/EEC relating to the type-approval of wheeled agricultural or forestry tractors and Council Directive 75/322/EEC relating to the suppression of radio interference produced by spark-ignition engines fitted to wheeled agricultural or forestry tractors (OJ L 28, 30.1.2001, p. 1).

28. 32003 L 0037: Directive 2003/37/EC of the European Parliament and of the Council of 26 May 2003 on type-approval of agricultural or forestry tractors, their trailers and interchangeable towed machinery, together with their systems, components and separate technical units and repealing Directive 74/150/EEC (OJ L 171, 9.7.2003, p. 1).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptations:

(a) In Annex III, Part I, Chapters A, B and C, the following shall be added to paragraph 16:

'- Iceland: ...'

'- Liechtenstein: ...'

'- Norway: ...'

(b) In Annex III, Part II, Chapters A and B, the following shall be added to paragraph 16:

'- Iceland: ...'

'- Liechtenstein: ...'

'- Norway: ...'"

Article 2

The texts of Directive 2003/37/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 7 February 2004, provided that all the notifications pursuant to Article 103(1) of the Agreement have been made to the EEA Joint Committee(8).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
