re-appointing a Deputy Director of Europol

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Convention on the establishment of a European Police Office (Europol Convention) [1], and in particular Article 29(2) thereof,

Acting as the authority vested with the power to appoint the Director and Deputy Directors of Europol,

Having regard to the opinion of the Management Board,

Whereas:

(1) The term of office of a deputy Director of Europol appointed by Council Act of 24 July 2006 [2], is due to expire by 31 August 2010.

(2) The Staff Regulations applicable to Europol employees [3], and in particular their Appendix 8, establish special provisions on the procedure for the re-appointment of the Director or a Deputy Director of Europol.

(3) The Deputy Directors of Europol are appointed for a four-year period extendable once in accordance with Article 38(2) of the Council Decision establishing the European Police Office (EUROPOL) ("Europol Decision") [4].

(4) Pursuant to Article 39 of the Europol Decision the Staff Regulations of the European Communities and the Conditions of Employment of other servants of the European Communities apply. This will be the case as from 1 January 2010, pursuant to Article 64(2) of the Europol Decision. According to Article 47(a) of the Conditions of Employment of other servants of the European Communities the employment of temporary staff ceases at the end of the month in which the servant reaches the age of 65 years.

(5) The Management Board presented the Council with an unanimous opinion proposing that the present Deputy Director of Europol, Mr Michel QUILL? be re-appointed.

(6) On the basis of the opinion provided by the Management Board, the Council wishes to re-appoint Mr Michel QUILL? as Deputy Director.

(7) As soon as possible after the date as from which the Europol Decision applies, the Council will determine the grade and step at which Mr Michel QUILL? has been re-appointed,

HAS DECIDED AS FOLLOWS:

Article 1

Mr Michel QUILL? is hereby re-appointed as Deputy Director of Europol from 31 August 2010 to 30 April 2014.

Article 2

This Act shall take effect on the day of its adoption.

It shall be published in the Official Journal of the European Union.
