of 26 February 1987

on applications for advance payment and repayment of aid granted by Greece to improve the structures of the wine sector under Regulation (EEC) No 895/85

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No 895/85 of 1 April 1985 on a common measure to improve the structures of the wine-making sector in Greece (1), and in particular Article 8 (4) thereof,

Whereas applications for repayment and applications for advance payment to be submitted by Greece to the European Agricultural Guidance and Guarantee Fund (EAGGF), Guidance Section, must contain certain data to enable expenditure to be checked against the provisions of Regulation (EEC) No 895/85 and the programme submitted by Greece and approved by the Commission in accordance with Article 2 (2) of the said Regulation;

Whereas, to enable effective checks to be conducted, Greece must keep supporting documents available for the Commission for a three-year period after the payment of the last repayment;

Whereas, to govern the payment of advances by the Commission, detailed rules and procedures must be laid down for the purpose;

Whereas the measures provided for in this Decision are in accordance with the opinion of the Committee of the European Agricultural Guidance and Guarantee Fund,

HAS ADOPTED THIS DECISION:

Article 1

1. Applications for repayment as referred to in Article 8 (1) of Regulation (EEC) No 895/85 must conform to the tables in Annexes 1 to 1.9.

2. With the first application for repayment, Greece shall forward to the Commission the texts of national implementing provisions and administrative instructions, together with forms and any other documents relating to the administrative implementation of the measure.

Article 2

Applications to the European Agricultural Guidance and Guarantee Fund, Guidance Section, for advance payment for eligible expenditure as referred to in Article 8 (3) of Regulation (EEC) No 895/85 must conform to the tables in Annexes 2 to 2.8.

Article 3

1. Advances from the European Agricultural Guidance and Guarantee Fund, Guidance Section, may be equal to a maximum of 80 % of the Community contribution to the financing of expenditure anticipated in the reference year.

2. Advances which are not spent during the year in respect of which they were paid shall be deducted from the advance to be paid for the following year.

Article 4

Before the end of each year in respect of which advances have been paid to Greece, the latter shall submit a report on operations carried out during that year in accordance with the tables in Annexes 3 to 3.8.

Advances for the following year may not be paid before the abovementioned report has been forwarded to the Commission.

Article 5

For a period of three years after the payment of the last repayment, Greece shall keep available for the Commission all supporting documents or certified copies thereof which are in its possession, on which the aid provided for in Regulation (EEC) No 895/85 and the applications for repayment and advance payment are based.

Article 6

This Decision is addressed to the Hellenic Republic.

IT IS HEREBY STATED THAT:

- the works in respect of which an application for repayment is submitted have been completed in accordance with the programme approved by the Commission in accordance with Article 2 of the Regulation;

- works which may qualify for Community aid under other common measures or for aid from the European Regional Development Fund have been excluded from this programme;

- Greece has resources for verifying effectively the items on which the calculation of eligible aid, paid under the EAGGF, was based;

- the recipients have been informed, as laid down, of the percentage of the loan coming from the Community;

- aid for restructuring complies with the provisions of Article 1 (4) and the ceilings laid down in Article 5 (1) (a) of the Regulation;

- the aid for support measures complies with the provisions of Article 1 (5) and the ceiling laid down in Article 5 (1) (b) of the Regulation;

- the aid for technical assistance required for the restructuring of the vineyard concerned by the common measure is limited to 5 % of the total costs.
