DECISION OF THE EEA JOINT COMMITTEE

No 9/2015

of 25 February 2015

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2016/497]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)	Regulation (EU) No 167/2013 of the European Parliament and of the Council of 5 February 2013 on the approval and market surveillance of agricultural and forestry vehicles (1) is to be incorporated into the EEA Agreement.

(2)

Regulation (EU) No 167/2013 repeals, with effect from 1 January 2016, Council Directive 76/432/EEC (2), Council Directive 76/763/EEC (3), Council Directive 77/537/EEC (4), Council Directive 78/764/EEC (5), Council Directive 80/720/EEC (6), Council Directive 86/297/EEC (7), Council Directive 86/298/EEC (8), Council Directive 86/415/EEC (9), Council Directive 87/402/EEC (10), Directive 2000/25/EC of the European Parliament and of the Council (11), Directive 2003/37/EC of the European Parliament and of the Council (12), Directive 2009/57/EC of the European Parliament and of the Council (13), Directive 2009/58/EC of the European Parliament and of the Council (14), Directive 2009/59/EC of the European Parliament and of the Council (15), Directive 2009/60/EC of the European Parliament and of the Council (16), Directive 2009/61/EC of the European Parliament and of the Council (17), Directive 2009/63/EC of the European Parliament and of the Council (18), Directive 2009/64/EC of the European Parliament and of the Council (19), Directive 2009/66/EC of the European Parliament and of the Council (20), Directive 2009/68/EC of the European Parliament and of the Council (21), Directive 2009/75/EC of the European Parliament and of the Council (22), Directive 2009/76/EC of the European Parliament and of the Council (23) and Directive 2009/144/EC of the European Parliament and of the Council (24), which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement with effect from 1 January 2016.

(3)	Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex II to the EEA Agreement shall be amended as follows:

(1)

the following point is inserted after point 39 (Directive 2009/68/EC of the European Parliament and of the Council):

‘40.	32013 R 0167: Regulation (EU) No 167/2013 of the European Parliament and of the Council of 5 February 2013 on the approval and market surveillance of agricultural and forestry vehicles (OJ L 60, 2.3.2013, p. 1).’;

(2)

the texts of points 8 (Council Directive 76/432/EEC), 9 (Council Directive 76/763/EEC), 11 (Directive 2009/57/EC of the European Parliament and of the Council), 12 (Council Directive 77/537/EEC), 13 (Council Directive 78/764/EEC), 17 (Directive 2009/75/EC of the European Parliament and of the Council), 18 (Council Directive 80/720/EEC), 19 (Council Directive 86/297/EEC), 20 (Council Directive 86/298/EEC), 21 (Council Directive 86/415/EEC), 22 (Council Directive 87/402/EEC), 23 (Directive 2009/144/EC of the European Parliament and of the Council), 28 (Directive 2003/37/EC of the European Parliament and of the Council), 29 (Directive 2000/25/EC of the European Parliament and of the Council), 31 (Directive 2009/64/EC of the European Parliament and of the Council), 32 (Directive 2009/63/EC of the European Parliament and of the Council), 33 (Directive 2009/66/EC of the European Parliament and of the Council), 34 (Directive 2009/76/EC of the European Parliament and of the Council), 35 (Directive 2009/58/EC of the European Parliament and of the Council), 36 (Directive 2009/59/EC of the European Parliament and of the Council), 37 (Directive 2009/60/EC of the European Parliament and of the Council), 38 (Directive 2009/61/EC of the European Parliament and of the Council) and 39 (Directive 2009/68/EC of the European Parliament and of the Council) shall be deleted with effect from 1 January 2016.

Article 2

The following indent is added in point 1c (Directive 2006/42/EC of the European Parliament and of the Council) of Chapter XXIV of Annex II to the EEA Agreement:

‘—	32013 R 0167: Regulation (EU) No 167/2013 of the European Parliament and of the Council of 5 February 2013 (OJ L 60, 2.3.2013, p. 1).’

Article 3

The text of Regulation (EU) No 167/2013 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 4

This Decision shall enter into force on 26 February 2015, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*).

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
