DECISION No 100 of 23 January 1975 concerning the refund of cash benefits provided by the institution of the place of stay or of residence on behalf of the competent institution and the details of refunding these benefits > THE ADMINISTRATIVE COMMISSION OF THE EUROPEAN COMMUNITIES ON SOCIAL SECURITY FOR MIGRANT WORKERS,

Having regard to Article 81 (a) of Council Regulation (EEC) No 1408/71, under which it is made responsible for dealing with all administrative questions arising from Council Regulations (EEC) No 1408/71 and (EEC) No 574/72;

Having regard to Articles 19 (1) (b), last sentence ; 22 (1) (ii), last sentence ; 25 (1) (b), second-last sentence ; 52 (b), last sentence ; 55 (1) (ii), last sentence ; 70 (1), second subparagraph ; 71 (1) (b) (ii), second-last sentence and 75 (2) (c) of Regulation (EEC) No 1408/71 ; Article 102 (3) and (5) of Regulation (EEC) No 574/72 and Article 107 of Regulation (EEC) No 574/72 as last amended by Regulation (EEC) No 2639/74;

Whereas Decision No 17 of 18 February 1960, published in the Official Journal of the European Communities of 3 May 1960, has become invalid on the entry into force of Council Regulations (EEC) No 1408/71 and (EEC) No 574/72;

Whereas, taking into account the provisions of the said Regulations, there are grounds for adopting a new decision concerning the refund of cash benefits provided by the institution of the place of stay or of residence on behalf of the competent institution;

Whereas it is important that the institutions of the place of stay or of residence are fully reimbursed irrespective of the rate of exchange applicable at the time of payment,

HAS DECIDED AS FOLLOWS: " 1. The institution of the place of stay or of residence shall be reimbursed in full by the competent institution for amounts awarded to persons concerned on behalf of the competent institution, in the currency of the country of stay or of residence, in accordance with Articles 19 (1) (b), last sentence ; 22 (1) (ii), last sentence ; 25 (1) (b), second-last sentence ; 52 (b) last sentence 55 (1) (ii), last sentence ; 70 (1), second subparagraph ; 71 (1) (b) (ii), second-last sentence and 75 (2) (c) of Regulation (EEC) No 1408/71.

2. This Decision shall be published in the Official Journal of the European Communities. It shall enter into force from 1 January 1975. " The Chairman of the Administrative Commission
