DECISION OF THE EEA JOINT COMMITTEE

No 32/2014

of 14 February 2014

amending Annex XX (Environment) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EC) No 1418/2007 of 29 November 2007 concerning the export for recovery of certain waste listed in Annex III or IIIA to Regulation (EC) No 1013/2006 of the European Parliament and of the Council to certain countries to which the OECD Decision on the control of transboundary movements of wastes does not apply (1) is to be incorporated into the EEA Agreement.

(2)	Commission Regulation (EC) No 740/2008 of 29 July 2008 amending Regulation (EC) No 1418/2007 as regards the procedures to be followed for export of waste to certain countries (2) is to be incorporated into the EEA Agreement.

(3)	Commission Regulation (EC) No 967/2009 of 15 October 2009 amending Regulation (EC) No 1418/2007 concerning the export for recovery of certain waste to certain non-OECD countries (3) is to be incorporated into the EEA Agreement.

(4)	Commission Regulation (EU) No 837/2010 of 23 September 2010 amending Regulation (EC) No 1418/2007 concerning the export for recovery of certain waste to certain non-OECD countries (4) is to be incorporated into the EEA Agreement.

(5)	Commission Regulation (EU) No 661/2011 of 8 July 2011 amending Regulation (EC) No 1418/2007 concerning the export for recovery of certain waste to certain non-OECD countries (5) is to be incorporated into the EEA Agreement.

(6)	Commission Regulation (EU) No 674/2012 of 23 July 2012 amending Regulation (EC) No 1418/2007 concerning the export for recovery of certain waste to certain non-OECD countries (6) is to be incorporated into the EEA Agreement.

(7)	Commission Regulation (EU) No 57/2013 of 23 January 2013 amending Regulation (EC) No 1418/2007 concerning the export for recovery of certain waste to certain non-OECD countries (7) is to be incorporated into the EEA Agreement.

(8)	Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following is inserted after point 32ca (deleted) of Annex XX to the EEA Agreement:

32007 R 1418: Commission Regulation (EC) No 1418/2007 of 29 November 2007 concerning the export for recovery of certain waste listed in Annex III or IIIA to Regulation (EC) No 1013/2006 of the European Parliament and of the Council to certain countries to which the OECD Decision on the control of transboundary movements of wastes does not apply (OJ L 316, 4.12.2007, p. 6), as amended by:

—	32009 R 0967: Commission Regulation (EC) No 967/2009 of 15 October 2009 (OJ L 271, 16.10.2009, p. 12),

—	32010 R 0837: Commission Regulation (EU) No 837/2010 of 23 September 2010 (OJ L 250, 24.9.2010, p. 1),

—	32011 R 0661: Commission Regulation (EU) No 661/2011 of 8 July 2011 (OJ L 181, 9.7.2011, p. 22),

—	32012 R 0674: Commission Regulation (EU) No 674/2012 of 23 July 2012 (OJ L 196, 24.7.2012, p. 12),

—	32013 R 0057: Commission Regulation (EU) No 57/2013 of 23 January 2013 (OJ L 21, 24.1.2013, p. 17).’

Article 2

The texts of Regulations (EC) No 1418/2007, (EC) No 740/2008, (EC) No 967/2009, (EU) No 837/2010, (EU) No 661/2011, (EU) No 674/2012 and (EU) No 57/2013 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 15 February 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (8).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

Declaration by the EFTA States to Decision of the EEA Joint Committee No 32/2014 of 14 February 2014 incorporating Commission Regulation (EC) No 1418/2007 and its amending Acts, Commission Regulation (EC) No 740/2008, Commission Regulation (EC) No 967/2009, Commission Regulation (EU) No 837/2010, Commission Regulation (EU) No 661/2011, Commission Regulation (EU) No 674/2012 and Commission Regulation (EU) No 57/2013 into the Agreement

‘Commission Regulation (EC) No 1418/2007 and its amending Acts deal with export of waste to third countries. The incorporation of these Regulations is without prejudice to the scope of the EEA Agreement.’
