COMMISSION DECISION of 21 January 1988 laying down the specimen pedigree certificates for the semen and embryos of pure-bred breeding animals of the bovine species and the particulars to be entered on those certificates

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No 77/504/EEC of 25 July 1977 on pure-bred breeding animals of the bovine species [1], as last amended by Regulation (EEC) No 3768/85 [2], and in particular Article 5 and the fifth indent of Article 6 (1) thereof,

Whereas under Aricle 5 of Directive 77/504/EEC it is for the Commission to determine, in accordance with the procedure laid down in Article 8 of that Directive, the specimen certificate that may accompany semen and embryos of pure-bred breeding animals of the bovine species when they enter, into intra-Community trade;

Whereas, under the fifth indent of Article 6 (1) of the abovementioned Directive, it is for-the Commission to determine, in accordance with the procedure laid down in Article 8 of that Directive, the particulars to be shown on the pedigree certificate that may accompany the semen and embryos of pure-bred breeding animals of the bovine species when they enter into intra-Community trade;

Whereas those certificates themselves may be dispensed with provided that the particulars mentioned in this Decision are already present in reference documentation referring to the semen or embryos of pure-bred animals of the bovine species that enter into intra-Community trade;

Whereas the specimen and the particulars to be shown on the pedigree certificate of pure-bred breeding animals of the bovine species are already laid down in Commission Decision 86/404/EEC [3] ; whereas the data on pure-bred animals of the bovine species should be included in those on sperm and fertilized ova;

Whereas the measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Zootechnics,

HAS ADOPTED THIS DECISION:

Article 1

The following particulars must be mentioned in the pedigree certificate of the semen of pure-bred breeding animals of the bovine species:

- updated data as listed in Article 1 of Decision 86/404/EEC concerning the bull that provides the semen as well as its blood group,

- information allowing identification of the semen, the date of its collection and the names and addresses of the semen collection centre and of the consignee.

Article 2

1. The following particulars must be mentioned in the pedigree certificate of the embryos of pure bred breeding animals of the bovine species

- updated data as listed Article 1 of Decision 86/404/EEC concerning the donor cow and fertilizing bull as well as both their blood groups,

- information allowing for the identification of the embryos, date of insemination, date of collection, and the names and addresses of the embryo collection centre and of the consignee.

2. If there is more than one embryo in a single straw this must be clearly stated and furthermore they must all have the same parentage.

Article 3

The particulars provided for in Article 1 may be indicated:

1. in the form of a pedigree certificate conforming to the model in Chapter I of Annex 1, and in the form of a document conforming to the model in Chapter 2 of Annex I ;

2. in documentation accompanying the semen. In this event the competent authorities of the exporting Member State must certify that the particulars set out in Article 1 are indicated in those documents, by the following formula:

The undersigned certifies that these documents contain the particulars mentioned in Article 1 of Commission Decision 88/124/EEC.

Article 4

The particulars provided for in Article 2 may be indicated:

1. in the form of a pedigree certificate conforming to the model in Chapter 1,of Annex 2, and in the form of a document conforming to the model in Chapter 2 of Annex 2 ;

2. in documentation accompanying the embryos. In this event the competent authorities of the exporting Member State must certify that the particulars set out in Article 2 are indicated in those documents, by the following formula:

Article 5

This Decision is addressed to the Member States.
