COMMISSION RECOMMENDATION No 3140/78/ECSC of 29 December 1978 concerning the anti-dumping duties imposed on certain iron and steel products

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Coal and Steel Community, and in particular Articles 74 and 86 thereof,

Having regard to Commission recommendation 77/329/ECSC of 15 April 1977 on protection against dumping or the granting of bounties or subsidies by countries which are not members of the European Coal and Steel Community (1), as amended by recommendation No 3004/77/ECSC (2), and in particular Articles 15, 17 and 18 thereof,

Having heard the opinions expressed within the Advisory Committee provided for by recommendation 77/329/ECSC,

Whereas since the beginning of 1978 the Commission has, by recommendations No 790/78/ECSC (3), No 811/78/ECSC (4), No 932/78/ECSC (5), No 1006/78/ECSC (6), No 1704/78/ECSC (7), No 1715/78/ECSC (8) and No 1758/78/ECSC (9), imposed a certain number of definitive anti-dumping duties on iron and steel products ; whereas certain of these duties have meanwhile been suspended;

Whereas the amount of these duties is equal to the amount by which the effective prices (basic price plus extras) established by contract, free-at-frontier duty-paid, are lower than the effective prices (basic price plus extras) published by the Commission (10) for the product in question;

Whereas by communication dated 29 December 1978 the Commission has amended these basic prices;

Whereas since then, the Commission has re-examined its dumping calculations;

Whereas this re-examination has confirmed that the basic prices, in their new version, are reasonable;

Whereas it is necessary, therefore, to provide that the collection of anti-dumping duties shall henceforth be carried out on the basis of the amended basic prices,

HAS ADOPTED THE FOLLOWING RECOMMENDATION:

Article 1

1. The amount of the anti-dumping duties imposed by recommendations No 790/78/ECSC, No 811/78/ECSC, No 932/78/ECSC, No 1006/78/ECSC, No 1704/78/ECSC, No 1715/78/ECSC and 1758/78/ECSC, shall henceforth be equal to the amount by which the effective price (basic price plus extras) established by contract, free-at-frontier duty-paid, is lower than the effective price (basic price plus extras) as published by the Commission on 30 December 1978 (11) for the product in question.

2. The other provisions of the abovementioned recommendations shall remain unchanged.

Article 2

This recommendation shall be notified to the Member States and published in the Official Journal of the European Communities.

It shall enter into force on 15 January 1979.
