amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2018/529]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area ('the EEA Agreement'), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Regulation (EU) 2016/127 of 25 September 2015 supplementing Regulation (EU) No 609/2013 of the European Parliament and of the Council as regards the specific compositional and information requirements for infant formula and follow-on formula and as regards requirements on information relating to infant and young child feeding (1) is to be incorporated into the EEA Agreement.

(2)

Commission Regulation (EU) 2016/479 of 1 April 2016 amending Annex II to Regulation (EC) No 1333/2008 of the European Parliament and of the Council as regards the use of steviol glycosides (E 960) as a sweetener in certain energy-reduced or with no added sugars beverages (2) is to be incorporated into the EEA Agreement.

(3)	Regulation (EU) 2016/127 repeals, with effect from 22 February 2020, Commission Directive 2006/141/EC (3), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 22 February 2020.

(4)

This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(5)	Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

(1)

the following point is inserted after point 77a (Commission Delegated Regulation (EU) 2016/128):

‘77b.

32016 R 0127: Commission Delegated Regulation (EU) 2016/127 of 25 September 2015 supplementing Regulation (EU) No 609/2013 of the European Parliament and of the Council as regards the specific compositional and information requirements for infant formula and follow-on formula and as regards requirements on information relating to infant and young child feeding (OJ L 25, 2.2.2016, p. 1).

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations:

(a)

in Annex VI Part A, the following shall be added:

—	in Icelandic: “Ungbarnablanda” and “Stoðblanda”,

—	in Norwegian: “Morsmelkerstatning” and “Tilskuddsblanding”.

(b)

in Annex VI Part B, the following shall be added:

—	in Icelandic: “Ungbarnamjólk” and “Mjólkurstoðblanda”,

—	in Norwegian: “Morsmelkerstatning basert på melk” and “Tilskuddsblanding basert på melk”.’;

(2)

the following indent is added in point 54zzzzr (Regulation (EC) No 1333/2008 of the European Parliament and of the Council):

‘—	32016 R 0479: Commission Regulation (EU) 2016/479 of 1 April 2016 (OJ L 87, 2.4.2016, p. 1).’;

(3)	the text of point 54zzzv (Commission Directive 2006/141/EC) shall be deleted with effect from 22 February 2020.

Article 2

The texts of Delegated Regulation (EU) 2016/127 and Regulation (EU) 2016/479 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 29 October 2016, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
